This Privacy Policy establishes how Linde Material Handling Ibérica, S.A.U., will process personal data collected through the website www.linde-mh.es (hereinafter, also referred to as the “website”). This Privacy Policy is also presented as additional data protection information in cases where basic prior information has been provided with a link to this website.

At Linde Material Handling Ibérica, S.A.U., we strive to ensure the confidentiality of the data provided by our users. 2. Purpose of Processing

LINDE will collect your personal data and process it in order to:

• Identify users who contact LINDE;
• Process orders, requests, or respond to petitions made by the user through any of the contact methods made available to the user on LINDE’s website;
• Provide services contracted by the user;
• Manage the contractual relationship that may exist between the parties;
• Send commercial advertising communications by any electronic or physical means that enable commercial communications. These commercial communications will be related to products or services offered by LINDE. • In case the user completes the employment form, personal data will be processed for the purpose of managing job applications submitted by the user, as well as storing and evaluating the submitted resume in relation to vacancies that may occur in the company.
• In the event that you have provided your personal data when visiting LINDE facilities, your data will be processed in order to manage your visit and correctly identify you.

3. Data Retention

In the event that the user has entered into a contract with LINDE, personal data will be retained while the contractual relationship between the parties is maintained and, in any case, until the period for demanding responsibilities derived from the contractual relationship and other legal obligations has elapsed (generally, 5 years).

In all other cases, the personal data provided will be retained until the data subject requests its deletion. Once deletion is requested, the data will be kept blocked, in accordance with the legal deadlines established in legal, fiscal, and accounting matters (generally, a period of 5 years).

4. Legal Basis for Data Processing

In the event that the user has entered into a contract with LINDE, the legal basis for data processing lies in the execution of the existing contract between the parties.

In all other cases where the user provides personal data through any form located on the website, the legal basis for processing your data will reside in the freely given consent, which may be withdrawn at any time.

In the case of data provided by visitors to LINDE facilities, the legal basis for processing will reside in the legitimate interest of the Data Controller.

5. Recipients

LINDE will not make any transfer or transmission of data, except by legal obligation.

In the event that any type of personal data transfer is to be made, the express, informed, and unequivocal consent of the user will be requested in advance.

6. Rights of the Data Subject

The user, in their capacity as data subject, can exercise the following rights:

• Right to request access to their personal data: Any person has the right to know whether LINDE processes personal data concerning them or not. Data subjects have the right to access their personal data.
• Right to request rectification of your data: This is, to obtain from the Data Controller the rectification of inaccurate personal data concerning you without undue delay.
• Right to request the deletion of your data (right to be forgotten): That is, the right to obtain, without undue delay from the data controller, the deletion of personal data concerning you, when any of the following circumstances occur:
  • When personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
  • When the data subject withdraws the consent on which the processing is based in accordance with Article 6(1)(a) of the GDPR, or Article 9(2)(a) of the GDPR, and it is not based on another legal ground.
  • When the data subject objects to the processing and there are no overriding legitimate grounds for the processing, in accordance with Article 21(1) and 21(2) of the GDPR.
  • When personal data have been unlawfully processed.
  • When personal data must be erased for compliance with a legal obligation established in Union or Member State law to which the controller is subject.
  • When personal data have been collected in relation to the offer of information society services as referred to in Article 8(1) of the GDPR.
• Right to request the limitation of processing: you will have the right to obtain from the data controller the limitation of data processing which are regulated by the norm and are:
  • When the data subject contests the accuracy of the personal data, for a period enabling the controller to verify the accuracy of such data.
  • When the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
  • When the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims.
  • When the data subject has objected to processing pursuant to Article 21(1) GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.
• Right to data portability: you will have the right to receive the personal data concerning you, which you have provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the data have been provided.
